SFLC: grote risico’s in gebruik van OOXML

Het Software Freedom Law Center (SFLC), dat zorgt voor juridische diensten en gratis advies voor open source software-ontwikkelaars, heeft een verklaring uitgegeven waarin het stelt dat Microsoft's Open Specification Promise (OSP) niet voldoende zekerheid en garantie biedt voor onder de General Public Licence (GPL) vallende implementaties van Office Open XML (OOXML). Er bestaat niet de zekerheid dat het formaat vrij blijft van patentaansprakelijkheid. De OSP bevestigt in algemene zin dat Microsoft zijn patentrechten niet zal gebruiken tegen gebruikers of ontwikkelaars van software die een aantal gespecificeerde interoperabiliteitsstandaarden implementeren, waaronder OOXML en de binaire Office-formaten. Die belofte stelt ontwikkelaars van andere bedrijven in staat om ondersteuning voor deze formaten te implementeren zonder intellectueel eigendoms-rechten aan Microsoft te hoeven betalen. 'We publicly conclude that the OSP provides no assurance to GPL developers and that it is unsafe to rely upon the OSP for any free software implementation, whether under the GPL or another free software license'.

Het SFLC benoemt twee aspecten van de OSP die potentieel open source implementaties van OOXML kunnen bedreigen met patentzaken. De eerste is dat de OSP alleen de huidige versie van de gespecificeerde standaarden betreft, wat betekent dat Microsoft dezelfde garantie kan weigeren voor toekomstige versies. 'Each new version is subject to Microsoft's ongoing discretion on a case by case basis. In other words, every time a specification changes, Microsoft can effectively revoke the OSP as it had applied to previous versions of that same specification. Microsoft states that it will commit to renewal of the promise for future versions of specifications subject to standardizing activity 'to the extent that Microsoft is participating in those efforts', which means that Microsoft reserves the right to cancel the promise with respect even to standardized specifications, by merely withdrawing from the relevant standard-setting workgroup or activity. While technically an irrevocable promise, in practice the OSP is good only for today'. Dit leidt tot aanzienlijke onzekerheid over het bestaansrecht op lange termijn voor implementaties onder de GPL. Daardoor zou met name de voortdurende redistributie van open source code onder de GPL in gevaar kunnen komen, waardoor het model in zijn bestaan wordt bedreigd. Het tweede punt betreft het feit dat de belofte 'does not apply to works beyond the scope of the covered specifications. As a result, GPL-licensed OOXML implementation source code that uses software methods covered by Microsoft's patents cannot be adapted for use in other contexts without creating patent liability. This limitation is antithetical to one of the principle functions of the GPL, which is to enable the repurposing of existing source code. OOXML implementation code that is covered by Microsoft's patents would consequently be encumbered in a manner that exposes downstream adopters to potential risk of infringement suits'. En, zo concludeert het SFLC, 'The OSP doesn't permit free software implementation: it permits implementation under free software licenses so long as the resulting code isn't used freely. The OSP cannot be relied upon by GPL developers for their implementations not because its provisions conflict with GPL, but because it does not provide the freedom that the GPL requires. Relying on the OSP is unsafe because new versions of specifications could be excluded from the OSP and because the resulting code could not safely be used outside a very limited field of use defined by Microsoft'. De beperkingen die door het SFLC worden geconstateerd vormen een grote uitdaging voor ontwikkelaars die GPL-software ontwikkelen. Ze hebben ook bredere consequenties. Het is namelijk de vraag, tenminste dat lijken de conclusies van het SFLC te suggereren, of GPL-implementaties toekomstige versies van OOXML kunnen ondersteunen. Dat lijkt verdacht veel op de vermaledijde 'vendor lock-in' waar iedereen graag van af wil en waarvoor een ISO-standaardisatie een oplossing voor had moeten zijn. In die zin had Microsoft wellicht beter het voorbeeld kunnen volgen van SUN, die iedere toekomstige versie van ODF wel vrij gemaakt heeft voor gebruik en verspreiding. Maar dat gaat wellicht iets te veel in tegen het op patentrechten gebaseerde business model van Microsoft….
