Witte Huis moet email bewaren, opnieuw

Het Witte Huis ontkomt niet aan de bewaarplicht voor e-mail, zo heeft een federale rechter bepaald. Het vonnis van de rechter werd uitgesproken in twee rechtszaken tegen het Witte Huis vanwege het (vermeende) verwijderen van e-mails. Twee particuliere organisaties, CREW (Citizens for Responsibility and Ethics in Washington) en het NSA (National Security Archive), werden in het gelijk gesteld in rechtszaken die ze tegen het bureau van de President van de Verenigde Staten (het Executive Office) hadden aangespannen, waarbij ze stelden dat de regering Bush in strijd handelde met de Federal Records Act. In deze wet wordt het bewaren van archieven van de federale overheid geregeld. Volgens deze partijen (en niet alleen volgens hen, zoals wij hier al eerder vermelden) zijn er maar liefst vijf miljoen e-mails van de Bush-regering spoorloos verdwenen. Het past allemaal is de argumentatie van het Executive Office dat zij exempt zou zijn van de federale wetgeving, althans in ieder geval van de Federal Records Act. Rechter Henry Kennedy, een US District Judge voor het District of Columbia, oordeelde dat het Witte Huis verplicht is 'to preserve media, no matter how described, presently in their possession or under their custody or control, that were created with the intention of preserving data in the event of its inadvertent destruction. Defendants shall preserve the media under conditions that will permit their eventual use, if necessary, and shall not transfer said media out of their custody or control without leave of this court'.


De belofte dat het Witte Huis de back-up tapes zou bewaren was volgens de rechter alleen niet genoeg. Volgens de Federal Records Act mogen overheidsinstanties archieven niet vernietigen zonder toestemming van een overheidsarchivaris, in dit geval de National Archivist. Meredith Fuchs, de advocate van het National Security Archive, zei: 'Judge Kennedy's order demonstrates how concerned he is about the White House's cavalier attitude to its records. Our hope, along with Crew, is to force the White House to restore the missing e-mails and then archive them properly so that they can be preserved for continuity of government and for the historical record'. Volgens de twee organisaties is het heel wel mogelijk dat de backuptapes al overschreven zijn voor de rechtzsaak begon. De beide partijen willen dat het WItte Huis in de rechtszaal komt uitleggen wat er met de miljoenen elektronische berichten is gebeurd. In hun aanklacht stellen ze dat 'Under this administration's watch, millions of email have gone missing and the White House has done nothing to reconstruct those historically important federal records or take steps to prevent further document destruction. When confronted with requests for information about the missing email problem, the White House has unilaterally removed itself from the public arena altogether by declaring that the OA is no longer an agency subject to government sunshine laws. In the short life of this lawsuit the White House defendants have refused to give adequate assurances of document preservation, refused to provide basic information and refused to meet with plaintiff's counsel to plan for discovery'. De zaak kwam aan het rollen toen de CIA in 2003 de naam van CIA-agent Valerie Plame lekte aan The Washington Post. Advocaat Patrick J. Fitzgerald onderzocht de zaak en onthulde in 2006 dat het Witte Huis een 'probleem' had met zijn archieven, waardoor bepaalde e-mails verdwenen konden zijn. De tijdsperiode waarvan de email kwijt zijn kende gebeurtenissen zoals de oorlog in Irak, Katrina, het ontslag van negen US Attorneys en de herbevestiging van de Patriot Act. 'A lot of times, the government says 'trust us, we will do the right thing'', zo zegt Fuchs. 'Judge Kennedey’s order shows he won’t just take their word for it. He will direct them to do the right thing'. Anne Weismann, van CREW, zei dat 'a temporary restraining order is necessary because the White House has repeatedly failed to assure the public that it would preserve back-up copies of the missing emails'. De regering heeft gesteld dat een dergelijke uitspraak niet nodig is. Blair C. Jones, woordvoerder van het Witte Huis, zei dat 'the White House’s office of administration has been taking steps to preserve and maintain the back-up tapes for the administration’s e-mail system. We have provided assurances to the plaintiffs and to the court that these steps were being taken. We will continue preserving the tapes in compliance with the court’s order'. Het Witte Huis heeft toegegeven dat de email waarschijnlijk niet gearchiveerd zijn, zoals zou hebben gemoeten. 'I think that the fact that the judge didn’t agree with that is pretty remarkable', zei Weismann. 'Who knows how many of the missing e-mails are accessible or if they are gone ?' Kennedy gaf aan dat hij zijn uitspraak baseerde op de aanbeveling van US Magistrate Judge John M. Facciola, die stelde dat een 'restraining order' noodzakelijk was. 'Without such an order, destruction of the backup media would be without consequence'. En dus komt ook het Witte Huis er niet onderuit om keurig netjes e-mails te archiveren, of ze dat nu wel of niet graag doen….
